Copyright Royalty Judges Announce Cost-of-Living Adjustment in Royalty Rates

On November 26, 2012, the Copyright Royalty Judges (“CRJs”) adopted a cost-of-living adjustment of 2.2% in the royalty rates paid by satellite carriers under the Copyright Act’s satellite carrier compulsory license provision. The Copyright Act requires the CRJs to annually adjust royalty rates to reflect any changes to the cost-of-living adjustment. The cost-of-living adjustment is based on the change in the Consumer Price Index from October 2011 to October 2012, which is 2.2%. The royalty rates paid by satellite carriers for the secondary transmission of broadcast stations for private home viewing and commercial viewing is 27 cents and 54 cents, respectively, per subscriber per month.

The new rates apply from January 1, 2013 to December 31, 2013.
